After broadly marketing the invention, if the startup is the best choice for commercializing the technology, OCR will negotiate with a representative of the company to grant a license to the new company. Also, under the Bayh-Dole Act, the University has an obligation to ensure that inventions funded by the Federal government are effectively commercialized. Under Yale policy, faculty, staff and students cannot represent the company in negotiations due to conflicts of interest.
